One year ago, I sent my very first piece of premium content to Democracy Docket members: the March 2024 Litigation Look Ahead. At the time, we were in the middle of a presidential election. Voting litigation was at the forefront of everyone’s minds, and my new newsletter promised “a preview of the cases, hearings, legal maneuvers, and emerging litigation trends that I will be watching in the month ahead.”
A year later, we are facing an all-out attack on democracy, and we are teetering on the brink of a full-blown constitutional crisis. Keeping up with all the court cases and legal battles—both those threatening the rule of law and those working to protect democracy—is more challenging than ever.
While my goal remains the same — to help you make sense of a dynamic and complex series of legal battles that could shape our country for years to come — over the past year, I and the Democracy Docket team have refined our approach.
Most notably, a year ago, I wrote two premium newsletters a month. Now, I write several each week. Meanwhile, Democracy Docket continues to publish free daily and weekly newsletters, along with regular news coverage on democracy and the courts.
The landscape has also changed. Last year, I could confidently present a snapshot of the prior month’s court wins and losses and highlight key cases to watch in the month ahead. The news cycle was fast, but nothing like it is today. Now, new lawsuits are being filed daily, fresh legal arguments are taking center stage, and courts across the country are constantly adapting.
And so must we.
As you know, I am not a professional commentator or pundit — I am a practicing lawyer. I have argued and won four cases in the U.S. Supreme Court, litigated hundreds of voting and election cases nationwide, and led more recount and post-election cases than anyone else.
One of the reasons I started Democracy Docket was to give you, our readers, the benefit of my experience and perspective in understanding how democracy is being fought for in the courts. I often describe my role as that of a sports announcer who, between playing the game, provides color commentary.
In my law practice, when I need to make sense of a situation — whether it’s a new law, a government action, or a court decision — I ask for a litigation assessment. This provides the background and context I need to make informed decisions. That is exactly what’s needed today, and it’s what I aim to provide in my writing.
As Democracy Docket enters its second year of premium content, we are formalizing this shift by replacing the Litigation Look Ahead with the Litigation Assessment. The changes may be subtle at first, but over time, the goal is to offer a deeper dive into the most important cases and legal trends rather than a broader, surface-level overview of the litigation landscape.
