The Constitution guarantees us the right to a fair trial in a court of law, before a neutral judge and a jury of our peers. But too often, government agencies like the National Labor Relations Board (NLRB) circumvent those rights with sham in-house tribunals, where the standard rules of evidence are thrown out and agency employees serve as prosecutor, judge, and jury.
It’s a story that Nick Hiran knows all-too-well. Employees at his Houston area restaurant filed complaints with the NLRB following a dispute with the restaurant’s then-manager, and he has yet to get his day in court. On Tuesday, Pacific Legal Foundation helped Nick file an appeal to the Fifth Circuit, fighting for the right to a fair trial—as the Constitution demands.
