                                      WHAT'S HAPPENING
REPUBLICAN PARTY BACKS BUSINESSES LAWSUIT AGAINST GOVERNOR AND ADMINISTRATION

A group of businesses and owners have filed a lawsuit against Gov. Lujan Grisham and two Cabinent members over illegal fines being imposed on businesses. The Republican Party of New Mexico organized and financed the legal action. The lawsuit, filed in the Ninth Judicial District Court in Curry County, calls for declaratory and injunctive relief in the wake of illegal closures and fines handed down. It claims that the governor and her Administration abused her powers by these actions. The lawsuit charges that the governor is illegally threatening and fining businesses $5,000 a day under the Public Health Emergency Response Act, something the state cannot do. Under the Public Health Emergency Response Act, such $5,000 civil penalties only pertain to court-ordered isolation and quarantines of individuals and cannot be imposed by the executive branch of government.

"This is unconstitutional. Gov. Lujan Grisham doesn't have the executive power to threaten and fine establishments under the law. Her actions are devastating our economy and killing locally owned businesses in our state," said Republican Party of New Mexico Chairman Steve Pearce. "There's been no common sense and no equity in the governor's order, and innocent business owners are being threatened, feeling the financial pain and losing their livelihoods."

Here's the lawsuit.

Here is an interview Chairman Pearce did with KOB-TV about the lawsuit.

REPUBLICAN STATE SENATORS CALL ON GOVERNOR TO REOPEN STATE

Sen. Gregory Baca and a dozen other Republican state senators sent a letter to the governor earlier this month, calling on her to reopen the state by May 21. She refused. The lawmakers told the governor they believed she could implement policies that will expedite a recovery plan that is science-based, fair and equitable, and would keep our citizens safe. They warned the governor of the dire consequences:

"The recent Department of Health orders, coupled with the separate and unrelated budget shortfall caused by over-optimism in the oil markets, will undoubtedly have disastrous effect on the New Mexico economy. This massive economic shortfall will impact services for those regularly receiving assistance as well as those who find themselves newly unemployed and impoverished."

In her response, the governor pointed to the national death toll and her policies, but failed to address the dying businesses, economy and peoples' livelihoods.

Her tunnel vision continues.

MORE NEW MEXICO BUSINESSES CLOSE AS ECONOMIC DESTRUCTION CONTINUES

The number of New Mexico eateries closing doors permanently is climbing. More than 200 have folded since the govenror's public health order was implemented.

The state recently shut down two restaurants that remained open to save themselves from ruin. The state suspended food permits for Jalisco Cafe in Silver City and Anaheim Jack's in Ruidoso. The actions came despite the restaurants taking precautions to stop the spread of COVID-19.

Here's the story from the Albuquerque Journal.

LARGE GATHERINGS IN NEW MEXICO MAY BE OVER FOR MORE THAN A YEAR

State tourism officials say gatherings of more than 100 people may not happen for at least a year. New Mexico Tourism Secretary Jen Paul Schroer announced that in a virtual meeting. That means stadiums, theaters and conference centers might remain empty for months. That also means the future of festivals, art markets and even large weddings is uncertain. If the state had planned and implemented its policies better in this crisis, this might not have to be the case. We need to reopen New Mexico now, fairly and safely.

PROGRESSIVES IN SANTA FE CONSIDER USING CAPITAL PROJECT FUNDS TO FILL BUDGET HOLE

There's talk now about robbing Peter to pay Paul among progressives. After being warned about budget problems and wild spending, they now face a serious fiscal crisis. We all face it. Their solution? Let's tap money already designated for capital projects--needed infrastructure, security etc--to band-aid the problem.

Here's the story.

David Brian Snider
House of Representatives District 61

Hi, I’m Brian Snider and I would like to serve in the House of Representatives for District 61. I have lived in New Mexico all of my life (47 years) As the School Superintendent in Jal, Vice Chairman of the Woolworth Trust that owns and operates the local Library and senior center, and a third generation Lea County citizen, I know how oil and gas helps communities across Lea County and New Mexico from an inside perspective. I would like to help remove some of the needless regulations that choke our economy and reduce funding to our schools, law enforcement, and our medical system. I want to make sure the tax dollars we are sending to Santa Fe are being spent on programs that are going to help the citizens of Lea County and protect their rights, not take their rights and send our oil money to Texas.
