At the top of House Republicans’ agenda for the new Congress? Attacks on
transgender people’s rights under Title IX. The first legislative action
in each Congress is a Rules bill, and as part of this bill the 119th
Congress has put forth policy that attacks trans rights, right out of the
gate!

Representatives reject attacks on transgender rights! >>

Trump and MAGA Republicans have been clear about their intent to legislate
away the rights of transgender people. The proposed law in the Rules
package seeks to redefine Title IX to deny protections to transgender
people in educational institutions. They want to redefine sex as “a
person’s reproductive biology and genetics at birth,” to explicitly
exclude transgender people from opportunities available to peers.

While this provision addresses trans inclusion in sports, redefining sex
under Title IX could have lasting ramifications for all people in schools
across the country. Right now, Title IX protects people from sex-based
discrimination in the classroom and on college campuses, whether that
means prohibiting discrimination on the basis of gender identity, sex,
pregnancy, or any other sex-based category.

Sex and gender are so much more than reproductive biology and genetics at
birth. Artificially limiting the protections of nondiscrimination and
anti-harassment laws in this way fails to cover many instances of
discrimination, both for transgender people and their cisgender peers.

There’s no question that transgender people are a vulnerable population
facing vicious attacks by MAGA and the Far Right. Transgender rights are a
core civil rights issue of our time. We must stand alongside groups that
are under attack and protect the rights of all of us to live as our true
selves.
