John, I've got good news and bad.

But first, let me remind you about our case on behalf of Rev. Patrick Mahoney.

Following January 6, 2021, the grounds of the U.S. Capitol were closed to demonstrations. Fences went up and the First Amendment ceased to exist outside the U.S. Capitol.

When Capitol Police finally removed the fencing, Rev. Mahoney thought the Capitol Grounds were once again open for First Amendment expression. So, he applied for a permit to hold a prayer vigil on September 11th.

The Capitol Police denied his request and told him the Capitol Ground remained closed for gatherings…well, closed for most gatherings.

Capitol Police had a policy allowing members of Congress and their friends to hold rallies and gatherings.

In other words, Capitol Police created a two-tiered system -- an abundance of First Amendment rights for lawmakers and the scraps for people like Rev. Mahoney.

But with your help, the Center for American Liberty sued the government on Rev. Mahoney’s behalf. And in May, the federal district court in DC ruled in our favor…

Stand with Rev. Mahoney

…stopping the Capitol Police from enforcing the unconstitutional "no demonstration zone" at the U.S. Capitol.

But the government asked the court to "stay" -- or pause -- that ruling pending its appeal. 

John, we just got the court's decision…

The good news is the court still agrees we are correct on the law -- the "no demonstration zone" is indeed unconstitutional.

But the bad news is the Capitol Police Board convinced the court that free speech on the Capitol Steps is a threat to national security until after the inauguration.

So, the grounds of the U.S. Capitol are once again closed to demonstration…

For everyone EXCEPT Rev. Mahoney and four of his supporters.

Worse, while the grounds of the U.S. Capitol should open back up to the public after the inauguration on January 20, 2025 -- the government still plans to appeal our victory.
