MCRGO Fights Attack on Gun Companies

On January 22, 2024, in a landmark decision, the U.S. Court of Appeals for the First Circuit ruled in favor of the government of Mexico, allowing its lawsuit against U.S. gun manufacturers, including Smith & Wesson, to proceed. MCRGO has financed an amicus brief in the case on behalf of the firearms manufacturers. It can be read HERE or by clicking on the image below. Mexico has some of the most restrictive gun control laws in the world. There is only one gun store in the country, on an Army base, that requires months of background checks for a civilian purchase. Despite this, Mexico has very high rates of violent crime. Since 2010, more than 200,000 people have been killed in Mexico, a homicide rate more than four times higher than the United States. Rather than cracking down on the Mexican cartels that are largely responsible for this violence, Mexico is instead seeking $10 billion dollars in compensation from Smith & Wesson and other American firearms manufacturers in an effort to drive them out of business.


The Mexican government isn't operating alone in this lawsuit. It is being aided by the Brady Center to Prevent Gun Violence, Global Action on Gun Violence, and other domestic and global anti-gun groups. They seek to attack legal firearms ownership in the United States by eliminating the sources of guns and ammunition Americans use to exercise our Constitutionally protected self-defense rights.


A federal law known as the Protection of Lawful Commerce in Arms Act (PLCAA) prevents lawsuits against firearms manufacturers as a result of harm caused by people who have committed crimes with their weapons. Mexico is attempting a novel strategy to get around the law by arguing that the PLCAA’s immunity should not apply to harm caused by the weapons abroad.


The Court of Appeals has ruled that the Mexican government “plausibly alleges” their claim is “statutorily exempt” from the immunity provided by the PLCAA. The judges also concluded the complaint “adequately alleges” that the gun makers “aided and abetted the knowingly unlawful downstream trafficking of their guns into Mexico.”


The case now goes to the United States Supreme Court. Due to the potential for a profound negative impact on gun owners in Michigan, the MCRGO Board of Directors has voted to contribute to this case.
