John – This week, we saw an outpouring of support from Governors across the country who are backing up my home state of Texas as Governor Abbott works to secure our border. There has been a lot of back and forth between the White House and Texas over this issue, and the Supreme Court has even gotten involved (though their ruling is more nuanced than the commentary would suggest). I am going to dive into all of this below. We are rapidly approaching our primary here in Texas, the first step to my re-election to Congress. I cannot win re-election without the support of committed patriots like you from across the country. TEXAS HAS A RIGHT AND OBLIGATION TO DEFEND ITSELF CLICK HERE TO READ Governor Greg Abbott is rightly going on the offensive against the Biden Administration as the White House tries desperately to stop Texas from implementing its own measures to secure our southern border. Joe Biden has fought against Governor Abbott’s efforts to put floating barriers in the Rio Grande, set up razor wire on the Texas-Mexico border, and take control of arresting illegal immigrants who have crossed into our state. Greg Abbott is fighting back, arguing that Texas has a right to self defense and security. That argument is strong. As Abbott notes, "The federal government has broken the compact between the United States and the States. The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting states, including immigration laws on the books right now. President Biden has refused to enforce those laws and has even violated them." This dereliction of duty has serious consequences. Texas is on the front lines of millions of illegal immigrants pouring into our country. Mexican drug cartels have operational control over the border, and deadly fentanyl has poured into our country. Texas has a legal right and a moral obligation to defend itself, even if Joe Biden doesn’t like it. AMERICA'S GOVERNORS SUPPORT TEXAS CLICK HERE TO READ Joe Biden is doing everything he can to avoid the most basic function of his office: secure the homeland. He has ignored federal immigration law and refused to take any decisive action to stop the surge of illegal immigration we’ve seen since he took office. But it’s more than failure to take action. Biden is actively stopping Texas from implementing its own measures to stem the tide of illegal immigration that impacts my state more than any other. Right now, Governor Greg Abbott is fighting back against the Biden Administration on multiple fronts. Joe Biden has threatened lawsuits over Texas’ seizure of Shelby Park near Eagle Pass. And Texas is engaged in a legal battle with the Biden Administration over cutting razor wire Texas set up to prevent illegal immigrant crossings. To state the obvious, securing America’s border is not Texas’ job. It’s the federal government’s job. But since the man in charge of the federal government - Joe Biden - refuses to do anything to secure the border, states need to step in and Texas has the greatest incentive to do so because we are bearing the greatest brunt of this crisis. Thankfully, America’s Republican governors have rallied to support Governor Abbott, expressing that Texas has a right to self defense that is guaranteed by our constitution. That kind of support will be critical as these legal battles heat up and as this illegal immigration crisis continues to run rampant. WHAT THE SUPREME COURT REALLY SAID IN ITS DECISION ABOUT TEXAS CLICK HERE TO READ As I mentioned earlier, Texas is engaged in a legal battle with the Biden Administration over razor wire Texas set up to stop illegal immigrants from crossing into Texas. It’s a commonsense measure - razor wire naturally deters people from trying to cross into our country illegally. So, naturally, Joe Biden wants Texas to remove it. The Supreme Court weighed in this week, ruling in a 5-4 decision that the federal government could not be barred by a lower court from removing the razor wire. The commentary surrounding this decision has been unsurprisingly ridiculous, with many on the left cheering the decision while accusing Texas of “defying” the Supreme Court. Andy McCarthy of National Review has a great piece explaining the decision in detail, which I encourage everyone to read above. Here is an excerpt: There is a great deal of moronic commentary accusing the State of Texas of defying the Supreme Court. In point of fact, the Supreme Court did not order Texas to do anything. It vacated an order by the Fifth Circuit that, during the pendency of an ongoing lawsuit between the feds and the state, barred federal authorities from cutting concertina wire that Texas has installed in parts of its 1,254-mile border with Mexico. That is, the Supreme Court (with no opinion, and over the objection of four justices, who also did not write) held that, for now, the lower courts may not prevent the federal authorities from dismantling barriers. That Supreme Court action did not direct Texas to do anything. The Court did not presume to tell Texas that it could not take action to protect its territory and exclude intruders — to have done so would have been constitutionally dubious for the reasons Justice Antonin Scalia explained nearly a dozen years ago in his Arizona v. United States opinion — which Governor Gregg Abbott has explicitly relied on, and which should be read, reread, and memorized. (Note: Abbott described the 2012 Scalia opinion as a “dissent”; it actually concurred in part and dissented in part with the Court’s multilayered decision.)
