TDI extends the comment period for the PPO/EPO rule proposal

The Texas Department of Insurance (TDI) has extended the period to submit comments on proposed amendments to 28 TAC ??3.3038, 3.3702 - 3.3705, 3.3707 - 3.3711, 3.3720, 3,3722, 3.3723; new ?3.3712 and ?3.3713; and the proposed repeal of ?3.3725. An audio recording of the January 10, 2024 rule hearing will be available on the TDI website within the next few days.

The proposed amendments, new sections, and repeal implement network adequacy requirements contained in House Bill 3359 (88R) and out-of-network payment standards and balance billing protections from Senate Bill 2476 (88R) and SB 1264 (86R). The proposal also addresses consumer protections, disclosures, guaranteed renewability, and contracting requirements, including provisions implementing additional legislation from 2023: HB 711, HB 1647, HB 1696, HB 2002, and SB 1003.
