Hello John — Prepare to hear this phrase a LOT from us over the next year: United States v. Rahimi. Why?
Because this fall, the Supreme Court will hear arguments about a shocking decision earlier this year in the Fifth Circuit Court (a lower Federal court), where they held that people with active domestic-violence restraining orders against them are legally entitled to possess firearms under the Second Amendment.
In doing so, the Fifth Circuit Court of Appeals signed a death warrant for domestic abuse survivors, given that abusers are five times more likely to kill their victims when they have access to a gun. Additionally, nearly 68 percent of mass shooters have a history of domestic violence.
But March For Our Lives and our partners filed a brief challenging that decision and luckily the Supreme Court listened. Now we have an opportunity to explain why the Fifth District Court’s decision is so dangerous and why it should be overturned. This is an opportunity for the Supreme Court to partially undo another dangerous decision they made last year in NYSRPA v. Bruen and clean up the legal mess they unleashed.
That's why we filed what's known as an "amicus brief" with the Supreme Court, urging them to take up this case, and will file another amicus brief when the Courts hear the case urging them to make sure that domestic abusers can’t obtain a firearm and cause harm.
