Standing Up for Choice Schools, Religious Freedom, and the Rule of Law VICTORY | Wisconsin Lutheran Wins Summary Judgment Against City of Milwaukee for Unlawful Property Tax Assessment Milwaukee County Circuit Court Judge David Borowski granted Wisconsin Lutheran High School summary judgment in an oral ruling on February 2, 2023, ordering a full refund of the 2021 tax assessment plus interest. Judge Borowski concluded that the property, which provides student housing as well as an outdoor classroom space and areas for bible study and other activities, was exempt from property taxation as a matter of law. Following that ruling, the school and the City recently entered into a settlement agreement refunding the school’s 2022 tax payment and providing for the property’s continued exemption so long as it continues to be used for educational purposes. 🗯 WILL Associate Counsel, Kate Spitz, stated, “Too often religious and private education institutions are targeted by bureaucrats and have nowhere to turn. WILL is proud to stand alongside Wisconsin Lutheran and help secure this long-lasting, generational victory in court. The law is clear, Wisconsin provides property tax exemptions for educational and religious institutions.” 🗯 Wisconsin Lutheran President, Rev. The bill now heads to Governor Evers. 🗯 Kyle Koenen, Policy Director, stated “The Wisconsin Legislature took bold, decisive action to more equitably fund a quality education for every single child. Instead of an insufficient status quo, money will more closely follow the student, competition and innovation will drive results, and families will be empowered to make the best decision for their child. Learn More UPDATE | WILL Files Federal Complaint Against WI School District, Demanding Action Following Troubling Locker Room Incident WILL filed a complaint with the U.S. Department of Education Office of Civil Rights following a troubling incident that occurred at Sun Prairie Area School District, where an 18-year-old biological male exposed himself to four female girls in the shower and stated “I’m trans, by the way.” Following the school's failure to sufficiently address the incident, and their stonewalling of an open records request, WILL is seeking an investigation and remedies from the Department of Education under the Biden Administration. 🗯 Cory Brewer, WILL Associate Counsel, stated, “Parents and students should feel safe and have peace of mind when kids go back to school this fall. But, the Sun Prairie Area School District has frankly been dismissive in how it has handled the alleged sexual harassment towards these four freshman girls. The Department of Education Office of Civil Rights should promptly investigate the allegations made in this complaint, then act swiftly to remedy unlawful policies and practices.” 🗯 Dan Lennington, WILL Deputy Counsel, added, “These troubling events are occurring across the country, and by no means what happened in Wisconsin is an isolated incident.
