On May 24, 2023, during its regularly scheduled meeting, the Liquor and Cannabis Board took the following actions:

New rulemaking initiated:

The Board approved a Preproposal Statement of Inquiry (CR 101) to consider amending WAC 314-02-1071 related to alcohol trade areas.

The Board approved a Preproposal Statement of Inquiry (CR 101) to consider implementation of 2023 legislation relating to liquor licensees.

Proposed rules filed ? Public comment period now open:

The Board approved a rule proposal (CR 102) to implement portions of Substitute Senate Bill (SSB) 5448 (chapter 279, Laws of 2023), that will go into effect on July 1, 2023. The bill modifies an existing rule that was implemented in 2022 which extended certain temporary privileges granted to liquor licenses to mitigate the impacts of the coronavirus. Among other things, SSB 5448 permanently allows outside or extended alcohol service, and the alcohol takeout service endorsement. SSB 5448 also removes allowance of alcohol curbside service and extends the alcohol delivery endorsement to July 1, 2025.

Since rules already exist concerning temporary privileges for liquor licensees, LCB is using the exception rulemaking process for this proposal to align rules with SSB 5448 as quickly as possible to provide regulatory continuity. RCW 34.05.310(4) describes this exception ?process that allows an agency to bypass the CR 101, or preproposal phase of rulemaking under certain limited circumstances, while retaining the public comment and public hearing component of standard rulemaking.
